zCallMagic is a communications technology platform. Businesses using zCallMagic are responsible for obtaining and maintaining the consent required to contact their recipients.
Responsible Business Communications with zCallMagic
zCallMagic is a business communications and automation software platform that enables independent organizations to manage contacts and communicate with their own customers, clients, patients, members, employees, and other authorized recipients through supported channels.
zCallMagic provides technology for communications, campaigns, reminders, notifications, and related automation. Each business is the sender of its communications and is responsible for determining whether it has the consent, permission, or other lawful authority required to contact each recipient.
Platform Role
zCallMagic does not independently build customer recipient lists or decide who should be contacted. It enables each customer to operate its own communication program.
How zCallMagic Is Used
Permitted business uses may include:
- Appointment confirmations and reminders
- Customer service, account, service, and business notifications
- Requested informational and transactional communications
- Authorized marketing and promotional communications
- Voice notifications, email, and supported business messaging channels
Permitted purpose and communication type depend on the business, recipient consent, applicable law, and channel requirements.
Who Sends the Messages?
The business or organization using zCallMagic is the sender of communications to its recipients. zCallMagic provides the software and communication-enablement technology used by that business.
The business determines who is contacted, why, what message is sent, which channel is used, and when communications are sent. zCallMagic does not independently select recipients for customer campaigns.
Recipient Consent
Before communicating through zCallMagic, customers are required to obtain all consent, authorization, or other lawful basis required for the applicable communication. Customers must maintain sufficient evidence where required.
Requirements may vary by purpose, channel, marketing or informational content, automation, prerecorded or artificial voice, recipient relationship, jurisdiction, and applicable telecommunications or consumer-protection requirements.
zCallMagic does not independently obtain recipient consent on behalf of every customer. Each customer must use its own lawful consent process and maintain appropriate evidence.
How Customers May Obtain Consent
Customers may use their own compliant consent processes, including:
- Business website, online form, intake, registration, appointment, or booking process
- Written agreement, paper authorization, or electronic authorization
- SMS keyword or QR-code-based opt-in
- Verbal consent where legally permitted
- An existing customer-management process or another legally permissible method
zCallMagic does not require every business to use a single zCallMagic-hosted consumer opt-in form. Each customer is responsible for ensuring that its actual consent process satisfies the requirements applicable to its messaging program.
Example of a Website SMS Disclosure
Example only: Businesses must adapt consent language to their actual use case and applicable requirements. These unchecked examples are not functional forms and do not prove consent for any customer.
I agree to receive informational SMS/text messages from [Business Name] regarding appointments, reminders, account updates, service notifications, and other requested communications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.
I separately agree to receive recurring marketing and promotional SMS/text messages from [Business Name]. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.
Customer Consent Certification
Before applicable outbound functionality is enabled, customers may be required to accept a Communications Compliance Agreement or equivalent electronic certification:
“By using zCallMagic communication services, the business certifies that it is responsible for obtaining and maintaining all legally required recipient consent or authorization and for honoring applicable opt-out and revocation requests.”
This certification establishes the customer's responsibility to zCallMagic; it does not substitute for a recipient's actual consent.
Consent Records
Depending on the program and consent method, appropriate records may include recipient name and contact information, date and time, method, consent language, source URL, form or agreement, electronic or written record, internal record, and revocation or opt-out history.
Customers may be required to provide evidence of their process or recipient consent in response to legitimate compliance, network, regulatory, or recipient inquiries. zCallMagic does not represent that it stores every recipient's proof of consent.
Imported Contacts
Importing a contact into zCallMagic does not create consent.
Customers must possess consent or other lawful authority before contacting imported recipients. Purchased lists lacking sufficient consent to the sending business, scraped or harvested contacts, stolen data, unauthorized third-party lists, and re-importing opted-out recipients to bypass suppression are prohibited.
zCallMagic may require customers to certify that imported contacts may lawfully be contacted through selected channels.
Opt-Outs and Revocation
STOP — opt outHELP — receive assistance informationThese are standard examples, not the only legally valid revocation methods. Businesses must honor applicable opt-out and revocation requests. zCallMagic may provide automated suppression or opt-out functionality for supported channels, but customers remain responsible for overall compliance and must not circumvent suppression mechanisms.
Messaging Identification
Businesses must accurately identify themselves where required. Messages should identify the sending business or program so recipients understand who is contacting them. Customer communications generally identify the customer business—not zCallMagic—because zCallMagic is the technology platform rather than the sender.
Communication Registrations
zCallMagic may assist customers with registration, verification, configuration, or activation of communication-enabled numbers, sender identities, messaging programs, and related resources.
- Customers must provide accurate business and registration information.
- Customers must describe their real use case and actual recipient opt-in workflow.
- Customers remain responsible for recipient consent and applicable messaging requirements.
Registration or approval of a communication resource does not constitute recipient consent and does not relieve the business of its compliance obligations.
zCallMagic may assist with number, sender, or campaign registration, but registration support does not create consent, replace customer-specific opt-in evidence, or transfer the sender's responsibility to zCallMagic.
Registration approval and continued resource availability cannot be guaranteed.
Customer-Specific Opt-In Evidence
When registration requires evidence, a customer may provide evidence of its actual consent process, such as a public form URL; screenshot of an online or paper form; booking workflow; keyword or QR-code instructions; a verbal consent script where permitted; or other relevant evidence.
If the process is private or behind authentication, the business may provide appropriate review evidence through the applicable registration process. This general compliance page does not itself prove recipient consent.
Example Messaging Program
Example informational messaging use case: A customer schedules an appointment with a business and provides appropriate consent to receive appointment notifications.
[Business Name]: Reminder: Your appointment is scheduled for [Date] at [Time]. Reply STOP to opt out or HELP for assistance.
Actual messaging content and consent requirements vary by business and use case.
Prohibited Messaging Practices
zCallMagic prohibits spam, unsolicited mass messaging, fraud, phishing, harassment, deceptive communications, illegal telemarketing, unauthorized marketing, unauthorized purchased or scraped lists, opt-out circumvention, sender-identity misrepresentation, evasion of network requirements, and other unlawful or prohibited communications.
zCallMagic may restrict, suspend, or terminate communication functionality for suspected abuse, fraud, unlawful activity, repeated complaints, or serious compliance concerns.
Message Delivery and Carrier Filtering
Delivery depends on communication networks, recipient devices and settings, filtering systems, supporting infrastructure, regulatory requirements, and other factors outside zCallMagic's control. zCallMagic does not guarantee message delivery, call completion, delivery time, number availability, registration approval, prevention of filtering, or continued availability of a communication resource.
Privacy and Mobile Messaging Data
Mobile telephone numbers, messaging opt-in information, and consent records are not sold or rented for unrelated third-party marketing purposes.
Information may be processed by service providers acting on behalf of zCallMagic or the applicable business only as reasonably necessary to provide, secure, operate, support, or comply with requested communication services.
Terms and Conditions
Customer use of zCallMagic is governed by the applicable Terms of Service and communications compliance obligations.
